By using Kivvie, you agree to these terms. Please read them.
1. Service Description
Kivvie is a parent-controlled YouTube app. Parents create child profiles, approve YouTube channels, and control content settings including Shorts and comments visibility.
Kivvie also offers Channel Packs -- curated bundles of YouTube channels recommended by other parents. These are not sponsored, paid, or commercially influenced by any content creator or third party. You can add or remove individual channels at any time.
2. Acceptance of Terms
By using Kivvie, you agree to these terms. If you don't agree, don't use the service.
3. User Accounts and Responsibilities
You are responsible for:
- Maintaining the confidentiality and security of your account credentials
- All activities that occur under your account
- Ensuring your Google account credentials are kept secure
- Monitoring and managing content accessible to child profiles under your account
- Regularly reviewing and updating approved channels to ensure age-appropriateness
4. YouTube API Services
Kivvie uses YouTube API Services to provide video content. By using Kivvie, you agree to be bound by the YouTube Terms of Service available at https://www.youtube.com/t/terms.
We do not host, store, or control any video content. All video content is provided directly by YouTube and remains subject to YouTube's policies and availability.
5. No Advertising and No Behavioral Tracking
Kivvie does not show ads of any kind. No ad identifiers, no frequency capping, no contextual targeting. Specifically, we do not:
- Use children's viewing data to build behavioral profiles or power recommendation algorithms (watch history and duration may be collected solely for parental visibility in the dashboard)
- Collect or process voice or audio data from children
- Use unique device identifiers for tracking or advertising purposes
- Share data with advertising networks, data brokers, or affiliate businesses
What children see is determined by the channels parents approve, not by algorithms or behavioral data.
6. Parental Responsibility
As the parent or legal guardian:
- You are solely responsible for selecting appropriate content for your children
- You acknowledge that Kivvie is a content filtering tool and does not guarantee the removal of all potentially inappropriate content
- You agree to actively monitor and manage your child's viewing experience
- You are responsible for setting appropriate usage limits and supervising your child's use of the application
7. Acceptable Use Policy
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable laws
- Attempt to bypass, disable, or interfere with security features of the service
- Use automated systems or software to extract data from the service
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Share your account credentials with unauthorized users
8. Subscriptions and Billing
8.1 Subscription Plans
Kivvie offers free and paid subscription plans. Paid plans unlock unlimited child profiles and channel approvals. Pricing is shown on the subscription page before you pay.
8.2 Auto-Renewal
Monthly and yearly subscriptions renew automatically at the end of each billing period. By subscribing, you authorize us to charge your payment method on a recurring basis at whatever the subscription price is at that time. You can cancel auto-renewal at any time through your account settings.
8.3 Cancellation
You can cancel your subscription at any time from the Plan page in your dashboard. When you cancel:
- You keep full access to paid features until the end of your current billing period
- Your account reverts to the free plan when the billing period ends
- No partial refunds are issued for unused portions of a billing period
8.4 Refunds
All purchases are final. We do not offer refunds for any subscription plan, including partial billing periods. If you believe you were charged in error, you may contact us at admin@kivvie.app. We may review such requests at our sole discretion but are under no obligation to issue a refund.
8.5 Price Changes
We may change subscription prices at any time. Price changes take effect at the start of your next billing period. Your continued use of the service after a price change constitutes acceptance of the new price. If you do not agree, you may cancel before the next billing period.
8.6 Payment Processing
Payments are processed by Airwallex Pty Ltd. We do not store your credit card details. All payment data is handled by Airwallex under PCI DSS standards. We are not liable for errors, delays, or failures in payment processing caused by Airwallex, your financial institution, or network disruptions.
8.7 Lifetime Plans
A lifetime plan is a one-time purchase granting access to paid features for the lifetime of the Kivvie service. "Lifetime" means the operational life of the app, not the lifetime of the purchaser. Lifetime plans do not renew and are non-refundable once purchased.
You acknowledge that:
- Kivvie depends on YouTube's platform and APIs, which are outside our control. Changes to YouTube's policies, APIs, or availability may affect the service, and no refund will be issued in such cases
- We may modify, update, or change features of the service over time. A lifetime plan entitles you to access the service as it exists at any given time, not to any specific feature set
- If we discontinue the Kivvie service entirely and permanently, no refund will be provided for lifetime plans
9. Service Availability
We try to keep the service running, but we do not guarantee uninterrupted, timely, secure, or error-free access. The service may go down for maintenance, updates, or reasons outside our control. We may modify, suspend, or discontinue any part of the service at any time without notice or liability.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that:
- The service will meet your requirements or expectations
- The service will be uninterrupted, secure, or error-free
- Any content accessed through the service (including YouTube content) will be appropriate, accurate, or safe for children
- The service will filter or block all potentially inappropriate content
You acknowledge that Kivvie is a content filtering tool and that you, as the parent or guardian, bear sole responsibility for supervising your child's viewing experience and verifying the suitability of approved channels.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIVVIE, ITS OPERATORS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
This applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. Specifically, we are not liable for:
- Any content your child accesses through approved YouTube channels
- Changes to YouTube's content, availability, or policies
- Errors, delays, or failures in payment processing by third-party providers
- Unauthorized access to your account resulting from your failure to secure your credentials
- Any damages arising from service interruptions, modifications, or discontinuation
To the extent we are found liable for any claim, our total aggregate liability will not exceed the lesser of (a) the amount you paid us in the 12 months before the claim, or (b) AUD $100.
You agree that you have no expectation of any specific outcome from using the service and that we bear no responsibility for how you or your children use the service.
12. Indemnification
You agree to indemnify, defend, and hold harmless Kivvie, its operators, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from or related to:
- Your use of the service
- Your violation of these terms
- Your violation of any third-party rights
- Content or channels you approve for child profiles
13. Assumption of Risk
You use the service at your own risk. You acknowledge and agree that:
- Kivvie relies on YouTube's platform, which we do not own or control. YouTube may change or remove content at any time
- No content filtering system is perfect. Approved channels may contain individual videos that are not suitable for all ages
- It is your responsibility as a parent or guardian to review approved channels and supervise your child's use of the app
- You are solely responsible for any decisions made based on the service
14. Changes to Terms
We may update these terms at any time. If you keep using Kivvie after a change, that counts as acceptance. It is your responsibility to review these terms periodically.
15. Termination
We can suspend or terminate your account for violating these terms, or for any other reason at our discretion. You can delete your account at any time through the app or by contacting us.
If we terminate your account for a breach of these terms, no refund will be issued for any remaining subscription period.
16. Governing Law and Disputes
These terms are governed exclusively by the laws of New South Wales, Australia, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
Any billing disputes must be raised within 30 days of the charge by emailing admin@kivvie.app. Disputes raised after this period will not be considered.
